Through its lawyers, Mhishi Nkomo Legal Practitioners, ZimParks issued summons against the mobile network provider on November 9, 2018, accusing the latter of breaching the terms and conditions of the lease agreement entered between the parties on January 29, 2012.
"On January 29, 2012, at Harare, the parties entered into a lease agreement in respect of a certain piece of land measuring 200 square metres, situated within the safari area of Hamlangwe, in Marongora Safari area for purposes of installing a transceiver base station," ZimParks said in its declaration.
Telecel is supposed to pay $3 600 per year in advance as rental, according to the agreement.
"In compliance with the agreement, the plaintiff gave the defendant vacant possession of the land. In breach of the lease agreement, the defendant has failed to make the rental payments timeously as agreed, and to this day, the defendant has accumulated rental arrears in the sum of $37 639,13," ZimParks said.
"Despite several attempts calling on defendant to settle the outstanding arrears, the defendant has failed, neglected or refused to pay the sum of $37 639 that is due and owing."
ZimParks is also claiming the cost of suit. Telecel Zimbabwe is yet to enter appearance to defend.
